Introduction
This Purchase Policy (“Purchase Policy”) applies to all purchases of tickets, registrations, and any related products or services (“Items”) made through the Rundown mobile application or the website at rundownevents.com (together, the “Platform”).
The Platform is operated by Rundown Events, a registered partnership in the Cayman Islands trading as “Rundown”, with operational offices at 18 Apple Blossom Gardens, P.O. Box 66, Grand Cayman KY1-1401, Cayman Islands (“Rundown”, “we”, “us”, or “our”). By placing an order, you (the “Purchaser” or “you”) agree to be bound by this Purchase Policy together with our Terms of Use and Privacy Policy.
This Purchase Policy does not apply to purchases or sales of Resale Tickets through our Ticket Exchange. Those transactions are governed by the Rundown Ticket Exchange Policy.
We may update this Purchase Policy from time to time. Each purchase is subject to the version of the Purchase Policy that was published on the Platform at the time the order was placed. Updated versions will be made available on the Platform; if you do not agree with a revised version, do not place a further order.
1. Our Role
1.1 Rundown operates a technology platform that enables event organizers, promoters, venues, and merchants (each, an “Organizer”) to list events and to sell tickets, registrations, and related Items to Purchasers. Rundown is the seller of the intangible rights contained in the ticket or registration, and the technology services that enable its sale, distribution, and validation.
1.2 The underlying event experience is provided by the Organizer, not by Rundown. The contract for the supply of the underlying event is between the Purchaser and the Organizer. Rundown is not the principal of the event and does not own, produce, host, or operate the event.
1.3 Where the Organizer has imposed event-specific terms (including age restrictions, conduct rules, dress codes, refund or exchange policies, or prohibited items), those terms apply in addition to this Purchase Policy. We will display Organizer terms within the booking flow or make them available at the venue entrance. Where any conflict arises between Organizer terms and this Purchase Policy, this Purchase Policy shall prevail unless we expressly agree otherwise in writing.
2. Your Rundown Account
2.1 To purchase Items through the Platform you must have a Rundown account. You are responsible for keeping your account details, including your email address and mobile number, accurate and up to date. You are responsible for keeping your password and authentication credentials confidential and for any activity that takes place through your account.
2.2 You must be at least 16 years of age to make a purchase. If you are under 18, or the age of majority in your jurisdiction, you may only place an order with the consent of a parent or legal guardian, who accepts responsibility for the transaction. By placing an order you confirm that these requirements are met. Tickets for age-restricted events (for example 18+ or 21+ events) may only be purchased and used by persons who meet the age stated on the event listing.
2.3 We may refuse to accept an order, suspend an account, or cancel and refund an order where we reasonably suspect fraud, misuse, breach of these terms, or any unlawful activity, or where we are directed to do so by a payment processor, regulator, or competent authority. In particular, we may exercise these rights where an account is associated with a known or suspected bot, scalper, automated buying tool, or duplicate purchase pattern.
3. Placing an Order
3.1 The display of an Item on the Platform is an invitation to treat. The placing of an order by you is an offer to buy that Item. We are under no obligation to accept your order (whether or not the order has been confirmed and payment authorised).
3.2 A binding contract for the sale of an Item is formed when we send you an order confirmation by email or in-app notification. You will receive a unique order reference number with your confirmation. Please keep your confirmation safe.
3.3 Quantities of Items per order, per event, and per account may be limited at our discretion or at the request of the Organizer. We may cancel any order, or any number of orders, that we reasonably believe exceeds such limits or that has been placed in breach of these limits.
3.4 Tickets are sold for personal, non-commercial use only. You may not resell tickets, list them on any third-party resale platform, or use them for commercial gain, except through our Ticket Exchange where the Organizer has enabled it and subject to the Ticket Exchange Policy.
4. Prices, Fees, and Payment
4.1 All prices for Items are inclusive of any applicable taxes and are displayed in either Cayman Islands Dollars (KYD) or United States Dollars (USD) as configured for the event by the Organizer. The currency that will be charged is clearly displayed at checkout. We accept no responsibility for additional charges that may be imposed by your card issuer or for fluctuations in foreign-exchange rates.
4.2 The total price you pay is made up of:
- the sale price of the Item (“Sale Price”);
- any per-Item service fee (“Service Fee”);
- any optional add-ons you choose at checkout, such as Missed Event Insurance (see clause 4.5).
4.3 Because tickets are issued and delivered digitally only (see clause 5), no physical delivery fees are charged.
4.4 We try to ensure that all prices on the Platform are accurate. If we discover a pricing error in an Item that you have ordered, we will inform you as soon as possible and give you the option of either (a) confirming your order at the correct price, in which case we will credit or debit the difference, or (b) cancelling your order, in which case you will receive a full refund. If we cannot contact you to confirm the corrected price, we may treat the order as cancelled and refund you in full without further liability.
4.5 For some events we may, in partnership with a third-party insurance provider, offer the optional purchase of Missed Event Insurance or similar ticket-protection coverage at checkout. Any such insurance is a separate contract between you and the insurance provider; it is not provided by Rundown and is not covered by this Purchase Policy. Please see the insurance provider’s own terms and conditions, which will be displayed at the point of purchase, for full details, including the events covered, the claims process, and the cooling-off period. Rundown may receive a commission from the insurance provider in respect of policies sold through the Platform.
4.6 Payment is processed through our payment processor (currently Stripe) and is taken in full at the time your order is accepted. By placing an order you authorise us and our payment processor to debit your chosen payment method for the total amount of the order.
5. Digital Tickets and Delivery
5.1 Rundown issues digital tickets only. All tickets purchased through the Platform are delivered electronically as a mobile ticket (a QR code) accessible through your Rundown account, the Rundown app, and (where applicable) by email. We do not issue or post physical tickets and do not charge delivery fees.
5.2 You are responsible for ensuring that you have access to a compatible mobile device with sufficient battery and connectivity to display your digital ticket at the venue entrance, or for taking a screenshot or downloaded copy of the QR code in advance. Where the venue has limited connectivity, we strongly recommend you download or screenshot your ticket before arrival.
5.3 Your digital ticket will typically be available in your Rundown account immediately upon successful payment. For some events, tickets may be released closer to the event date, in which case the release timing will be disclosed at the point of purchase.
5.4 You must not screenshot, photograph, copy, scan, or otherwise duplicate your QR code and provide it to any third party other than via our official Ticket Transfer feature (see clause 6). Each QR code is single-use; the first scan admits entry, and any subsequent scan of the same code will be rejected. We accept no liability for refused entry where a QR code has already been scanned, or where a duplicate code has been presented at entry.
6. Ticket Transfer
6.1 Where the Organizer has enabled it for an event, you may transfer one or more of your tickets to another person free of charge using the Ticket Transfer feature in your Rundown account. The recipient must have, or create, a Rundown account to accept the transfer.
6.2 To transfer a ticket, you initiate a transfer from your Rundown account by entering the recipient’s name and email address or mobile number. The recipient will receive an invitation, and the transfer is completed once the recipient accepts the invitation.
6.3 Once a recipient accepts your Ticket Transfer invitation, the following applies:
- you will not be able to use the original QR code for event entry, as it will be cancelled and a new QR code will be issued to the recipient;
- you will not be able to cancel the transfer or recall the ticket once accepted, except where the recipient transfers the ticket back to you using the same feature;
- you will not be able to list the same ticket on our Ticket Exchange.
6.4 If a ticket is transferred multiple times using Ticket Transfer, only the ticket from the most recent accepted transfer will be valid for entry; all previous QR codes will be cancelled.
6.5 You may only transfer tickets to a person you know personally and may not sell tickets through Ticket Transfer. The Ticket Transfer feature is not a resale mechanism; resale must take place only through our Ticket Exchange and is subject to the Ticket Exchange Policy.
6.6 Any Missed Event Insurance, add-ons, or fan-club benefits associated with the original ticket may not transfer to the recipient. Such items are personal to the original Purchaser and the original Purchaser remains responsible for any claims relating to them. Where an event is cancelled, rescheduled, or materially altered and refunds become available, only the original Purchaser (the person who first purchased the ticket on the Platform) is eligible to claim such refund. Recipients of transferred tickets must transfer the ticket back to the original Purchaser to enable refund claims.
7. Ticket Exchange (Fan-to-Fan Resale)
7.1 For some events, where the Organizer has enabled it, you may list a ticket for sale on our Ticket Exchange. The Ticket Exchange is a fan-to-fan resale facility that allows Purchasers to resell tickets to other Purchasers at a price within limits set by us and the Organizer.
7.2 All listings, sales, and purchases on the Ticket Exchange are subject to the Rundown Ticket Exchange Policy, which forms a separate agreement between you and us and (in respect of fan-to-fan sales) between you and the other Purchaser. This Purchase Policy does not apply to purchases or sales of Resale Tickets on the Ticket Exchange.
7.3 If you sell a ticket through the Ticket Exchange, your right to a refund under this Purchase Policy will be affected. Any sums you have received in respect of the resold ticket will be taken into account in calculating any refund to which you may be entitled.
8. Event Information
8.1 We display event information provided by the Organizer. While we take reasonable steps to ensure that event information is accurate and up to date, we do not guarantee its accuracy and accept no liability for inaccuracies in the information provided by Organizers. The Organizer is solely responsible for the accuracy and completeness of all event information.
8.2 We will use reasonable efforts to notify you, by email or in-app notification using the contact details associated with your Rundown account, of any material change to the event details after your purchase, including any cancellation, rescheduling, or material alteration. It is your responsibility to keep your account contact details up to date.
9. Event Conduct and Entry
9.1 Entry to an event is subject to:
- presentation of a valid digital ticket QR code on a mobile device at the entrance;
- compliance with any age restrictions, capacity limits, or other admission requirements imposed by the Organizer or venue;
- compliance with the Organizer’s and venue’s rules of conduct;
- compliance with applicable Cayman Islands law, including but not limited to laws relating to public order, intoxication, and prohibited substances.
9.2 The Organizer and the venue reserve the right to refuse entry to, or to remove from the event, any person who breaches event rules, who behaves in a manner that is unsafe, threatening, abusive, or unlawful, or who in their reasonable opinion poses a risk to the event, other attendees, performers, or property. Where entry is refused or a person is removed in such circumstances, no refund will be payable.
9.3 You attend events at your own risk. Live events involve inherent risks, including (but not limited to) loud noise, strobe lighting, crowds, and physical activity. Where the event involves activities that may carry additional risk, the Organizer will provide event-specific warnings. We accept no liability for any injury, illness, loss, or damage suffered by you in connection with attendance at an event, except to the extent caused by our own negligence and to the extent permitted by applicable law.
10. Cancellations, Reschedules, and Refunds
10.1 Cancellation of the event by the Organizer or by us
If an event is cancelled in full by the Organizer or by us, we will issue you a full refund of the Sale Price and the Service Fee, using the same means of payment as you used for the initial purchase. Refunds will typically be initiated within ten (10) business days of confirmation of the cancellation; the time taken for refunds to reach your account depends on your card issuer or bank.
10.2 Rescheduling of the event
If an event is rescheduled, your ticket will remain valid for the rescheduled event. If you cannot attend the rescheduled date, you may request a refund of the Sale Price and the Service Fee by contacting us through your Rundown account within fourteen (14) days of our notification of the rescheduled date, or by such other deadline as we may communicate. Refunds will be made using the same means of payment as you used for the initial purchase.
10.3 Material alteration of the event
If an event is materially altered after you have purchased your ticket, you may request a refund of the Sale Price and the Service Fee within fourteen (14) days of our notification of the alteration.
In this Purchase Policy a “material alteration” means a change to the event which, in our reasonable opinion, makes the event materially different from the event you originally purchased a ticket for. The following are not deemed to be material alterations: the use of understudies in theatre performances; adverse weather conditions that do not result in cancellation; changes of any supporting act; changes to individual members of a band; changes to the line-up of any multi-performer event such as a festival; curtailment of the event where the majority of the event is performed; delays to the start of the performance; minor changes to performance order or set times; and changes to the venue’s ancillary offerings (such as food, beverage, or merchandise availability).
10.4 No other refunds
Outside the circumstances set out in clauses 10.1 to 10.3, and except where required by applicable Cayman Islands law, tickets are non-refundable and non-exchangeable. If you are unable to attend an event for personal reasons (including illness, change of plans, work or travel commitments), no refund is payable, but you may transfer your ticket using the Ticket Transfer feature (clause 6) or, where enabled, list it on the Ticket Exchange (clause 7).
10.5 Service Fees
Where a refund is payable to you under clauses 10.1 to 10.3, the Service Fee will be refunded together with the Sale Price. Where you cancel or transfer your ticket for any reason other than cancellation, rescheduling, or material alteration of the event, the Service Fee is non-refundable.
10.6 Missed Event Insurance and other add-ons
Missed Event Insurance is a separate contract between you and the insurance provider and is governed by their terms. Refund of insurance premiums is subject to those terms, including any cooling-off period offered by the provider. Rundown is not responsible for assessing or processing insurance claims. Other add-ons purchased through the Platform (where offered) may be subject to their own refund rules, which will be disclosed at the point of purchase.
10.7 Refund method
All refunds will be made using the same means of payment as you used for the initial purchase, except where we are unable to do so for reasons beyond our reasonable control, in which case we will contact you to agree an alternative method.
11. Chargebacks and Disputes
11.1 If you believe there has been an error with your order, please contact us through your Rundown account or by email to the support address published on rundownevents.com in the first instance, so that we may attempt to resolve the matter.
11.2 You agree not to initiate a chargeback or payment dispute with your card issuer in respect of a Rundown order without first contacting us and giving us a reasonable opportunity to resolve the matter. We reserve the right to dispute any chargeback we consider to be initiated in breach of this clause or without reasonable grounds, and to recover any associated costs (including chargeback fees) from the Purchaser.
12. Intellectual Property
12.1 The Platform, its content, and the QR codes and digital tickets issued through it are protected by copyright, trade mark, and other intellectual property rights owned by or licensed to Rundown. You are granted a limited, non-exclusive, non-transferable licence to use the Platform and digital tickets for personal, non-commercial use only, in accordance with these terms.
12.2 You must not use the Platform, your account, or your digital tickets to advertise, promote, or scalp tickets, to operate a competing service, to engage in any commercial activity, or in any other way prohibited by our Terms of Use.
13. Our Liability
13.1 Nothing in this Purchase Policy limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable Cayman Islands law.
13.2 Subject to clause 13.1, our total aggregate liability to you arising out of or in connection with a particular order (whether in contract, tort, including negligence, breach of statutory duty, or otherwise) shall not exceed the total amount paid by you to us in respect of that order.
13.3 Subject to clause 13.1, we shall not be liable to you for any indirect, consequential, special, or punitive losses, or for any loss of profits, revenue, business, goodwill, opportunity, or data, whether arising in contract, tort, or otherwise.
13.4 Live events are produced by Organizers and not by Rundown. We are not responsible for the conduct of Organizers, performers, venues, or other attendees. Any complaint regarding the running of the event itself should in the first instance be directed to the Organizer.
14. Personal Data
14.1 Our collection and use of your personal data is governed by our Privacy Policy. By placing an order you confirm that you have read our Privacy Policy.
14.2 You acknowledge that we will share necessary information with the Organizer for the purposes of operating the event (such as name and ticket-tier information), and with our payment processor, insurance partner (if you purchase Missed Event Insurance), and other service providers strictly as necessary to fulfil your order and process refunds.
15. General
15.1 This Purchase Policy, the Rundown Terms of Use, and the Rundown Privacy Policy together constitute the entire agreement between you and us in relation to your use of the Platform and your purchase of Items.
15.2 If any provision of this Purchase Policy is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
15.3 No failure or delay by us in exercising any right or remedy under this Purchase Policy shall operate as a waiver of that right or remedy.
15.4 You may not assign or transfer your rights under this Purchase Policy. We may assign our rights and obligations under this Purchase Policy without your consent.
15.5 This Purchase Policy is governed by the laws of the Cayman Islands. Any dispute arising out of or in connection with this Purchase Policy shall be subject to the exclusive jurisdiction of the courts of the Cayman Islands. Nothing in this clause affects any non-waivable rights you may have under applicable consumer-protection law.
